Freelancer ₹25L Tax Story: 44ADA Saves ₹1.17L + Why a Big Refund Follows

Arjun (designer, ₹25L digital receipts, ₹6L real expenses): 44ADA taxes only ₹12.5L → ₹70,200 tax. Books would tax ₹19L. Clients cut 10% TDS (₹2.5L) → ~₹1.8L refund. Plus: GST registration needed above ₹20L.

44ADA vs books — the verdict

44ADA (50%)Books (actuals)
Taxable income₹12,50,000 (no books, ITR-4)25L − 6L = ₹19,00,000 (ITR-3)
New-regime tax + cess₹70,200≈₹1,87,200
Verdict44ADA wins by ≈₹1.17L — no books, no audit, ITR-4.

The famous 44ADA refund quirk

Clients deduct 194J 10% on the full ₹25L = ₹2,50,000 TDS. Liability is only ₹70,200 — so Arjun claims a ~₹1,79,800 refund every year. Legal, routine, and the #1 reason freelancers must track 26AS/AIS.

Arjun's compliance list

  • ITR-4 (44ADA) · advance tax in ONE instalment by 15 March (44ADA rule).
  • GST registration: services above ₹20L — invoicing + returns join the picture.
  • Foreign clients? FIRC per remittance + yearly LUT for zero-rated export.
  • Opting out of 44ADA later = locked out 5 years — decide carefully.

Two things 44ADA freelancers always forget (Ananya's checklist)

  • Advance tax — single installment relief: normal taxpayers pay 15/45/75/100% quarterly, but 44AD/44ADA cases pay 100% by 15 March in one shot. Miss March 15 and 234B/234C interest applies — set a calendar alert for March 1, not March 15.
  • GST registration at ₹20L services: 44ADA is INCOME tax; GST is separate. Cross ₹20L of service receipts and GST registration becomes mandatory (invoicing, returns, the works) — budget ~18% pricing headroom or watch margins bleed.
  • Match every TDS credit: with 10% TDS on gross receipts, a single missing 26AS entry costs real refund money. Reconcile client-wise in March; chase corrections BEFORE filing, not after.
⚠️ Mistake we see: 44ADA opt-out without knowing the 5-year lock
Declare lower-than-50% income one year (with audit + books) and you can't return to 44ADA for 5 years — plus mandatory audit if income exceeds exemption. For Ananya-scale freelancers (₹25L, real 24% margin), opting out 'to save a little' usually costs MORE in CA fees + audit + lost simplicity than it saves in tax. 44ADA is a roach motel by design: check in happily, check out only with a 5-year plan.
