House Property — Let-Out

Rental Income Tax: 30% Deduction, Municipal Tax, Interest & ₹2L Cap

Taxable rent = (rent − municipal tax) − 30% − home-loan interest. Let-out interest has no cap, but loss set-off vs salary is capped at ₹2L/year. Co-owned, arrears + 2-house rule inside.

− Full home-loan interest (let-out: no ₹2L cap)Pre-construction: ⅕ × 5 yrs
Example — ₹25,000/month rent, ₹3L interest
Annual rent ₹3,00,000 − municipal ₹12,000 = NAV ₹2,88,000. Less 30% (₹86,400) = ₹2,01,600. Less interest ₹3,00,000 = loss ₹98,400 — set off vs salary this year (within the ₹2L cap), balance carried 8 years.

5 rules landlords miss

  • ₹2L loss cap: house-property loss vs other heads capped at ₹2L/year; excess carried forward 8 years.
  • 2 self-occupied exempt: own 2 homes you live in? Both tax-free (since Budget 2019) — the 3rd is deemed let-out.
  • Arrears: taxable in the year received with 30% deduction — even if you sold the house.
  • Co-owned: each co-owner is taxed only on their share (and claims their own interest share).
  • Unrealised rent: deductible only if genuinely irrecoverable + conditions met (defaulter out, legal steps taken).

💡 Pro tip: the 30% + municipal + interest triple-stack
Rental math in one line: (Rent − municipal tax paid) − 30% flat − full home-loan interest = taxable. Three things owners miss: (1) municipal tax is deductible only if actually PAID that year; (2) the 30% needs zero bills — it's automatic; (3) co-owned property splits BOTH rent and the interest cap per owner. And if annual rent is below... there's no minimum — even ₹8,000/month rent is taxable income. Declare it; AIS already knows.
