ITR Filing: Last Date & Process for Tax Year 2026-27
The filing framework is familiar — Sec 139 is now Sec 263. The terminology moved to "Tax Year", forms are being renamed, and the ITR-U (updated return) window doubled to 4 years.

How to File ITR Online — Step by Step
- Step 1: Collect documents — Form 16 (employer), AIS/TIS + Form 168 (portal), bank statements, investment proofs
- Step 2: Match AIS entries with your own records; report mismatches using the feedback option
- Step 3: Choose your regime — new is the default; tick the old-regime option in the ITR if it wins for you
- Step 4: Pick the right form (ITR-1 to ITR-4 — see table below) and fill online at the e-filing portal
- Step 5: Verify pre-filled data (salary, interest, TDS), claim deductions and check tax payable/refund
- Step 6: Pay any balance tax, submit the return
- Step 7: e-Verify within 30 days (Aadhaar OTP / net banking / DSC) — an unverified return is treated as not filed!
Example — ITR-U to the rescue — forgot the FD interest
Zoya filed her ITR in July 2027. In March 2028 she realised she had skipped ₹90,000 of FD interest!
• Under the old rule, updated returns were allowed only for 2 years.
• Now she has 48 months — she can file an ITR-U even in 2029, paying the graded additional tax (25%/50%/60%/70% depending on when she files) plus tax and interest.
• Voluntarily correcting before a notice always beats the penalty route.

Which ITR Form? (Same Familiar Structure)
| Form | Who it's for |
|---|---|
| ITR-1 (Sahaj) | Salary + one house property + other sources; total income ≤ ₹50L; no capital gains, no business |
| ITR-2 | Capital gains / multiple properties / foreign assets (no business income) |
| ITR-3 | Business/profession income (regular computation) |
| ITR-4 (Sugam) | Presumptive taxation — Sec 58/59 (old 44AD/44ADA) taxpayers |
Form names/numbers for the new Act will be notified on the portal — FY 2025-26 (AY 2026-27) forms remained under the old Act.
The 5-Point Pre-Filing Checklist
- Match AIS/TIS + Form 168 (old 26AS) — salary, FD interest and TDS come pre-filled; mismatches invite notices
- Form 16 will now say 'Tax Year 2026-27' (your employer issues it for the July 2027 filing)
- Choose your regime consciously — new is the default; to use the old regime, select it in the return (business taxpayers have switching restrictions)
- Capital losses carry forward only if the ITR is filed on time
- For refunds, your bank account must be pre-validated and PAN-Aadhaar linked — otherwise refunds get stuck
What Happens If You File Late?
- Late fee (old 234F): ₹1,000 (income ≤ 5L) or ₹5,000 — interest/penalty provisions are consolidated at Sec 415–417 in the new Act
- Interest — the equivalents of old 234A/B/C: 1%/month for late filing, 1%/month for advance-tax defaults
- You lose the right to carry forward losses (capital loss, business loss)
- Even if a refund is due, delays multiply — filing on time is simply smart
Faceless & Digital: the new Act gives faceless assessment/appeal schemes statutory backing. Notices arrive by email/portal — keeping your registered email and mobile updated is no longer optional, it's a survival skill.
Our take ✍️
File on 31 July even when your tax is zero. Why? Refunds, visa files, loan applications, and loss carry-forwards all need that ITR-V. The cost of filing early is nil; the cost of filing late starts at ₹1,000 and climbs. Early filing is the cheapest financial habit in India.
⚖️ Legal footing: the 139 family, mapped
Every deadline on this page is a sub-section of Sec 139 (2025 Act: Sec 263): 139(1) due date (31 Jul / 31 Oct), 139(4) belated (31 Dec + fee), 139(5) revised (31 Mar), 139(8A) updated return ITR-U (48 months + graded tax), 139(9) defective (15 days to cure). Verification rides alongside (30-day rule). Quote the sub-section, not just 'the deadline' — precision gets faster answers from every helpdesk.
