How to Read Any Income-Tax Section Number (Clause, Proviso) + 2025 Finder
Your notice quotes '139(9)' and your CA replies citing '56(2)(x) read with Rule 11UA'. These aren't codes — they're addresses. Decode the system in 10 minutes, then map any old number to the 2025 Act.
Every citation in Indian tax law follows one grammar: Section (sub-section) clause, plus helpers called provisos, explanations and rules. Learn the grammar once and every notice, circular and guide becomes readable — including ours.
The anatomy table (memorise this, decode anything)
| Part | What it is | Example |
|---|---|---|
| Section | The main law unit (Act has 536 in 2025 version) | Sec 139 (returns) |
| Sub-section | Numbered division in brackets | 139(4) = belated return |
| Clause | Lettered item inside (a), (b)… (x) | 56(2)(x) = gifts clause |
| Sub-clause | Roman-numeral split of a clause | (x)(ii)-style deeper splits |
| Proviso | 'Provided that…' — exception carved INTO the rule | 87A's marginal-relief proviso |
| Explanation | 'For the removal of doubts…' — clarifies meaning | Deems what counts as 'transfer' |
| Illustration | Worked mini-example inside the Act itself | Yes — the Act contains examples! |
| Rule | CBDT procedure under the Act (separate book) | Rule 279 (HRA cities)* |
*HRA cities currently reported as Rule 279 of the Income Tax Rules 2026 (old Rule 2A). Rules renumber across editions — always verify the current Rules book.
Section vs Rule (the confusion that wastes hours)
Sections are the law passed by Parliament (the Act). Rules are CBDT's procedure manual under it (how to compute, which form, which cities). Sections say 'HRA exempt up to 50% in metros'; the Rule names the metros. Two more Rules worth knowing: Rule 3 (perquisite valuation — company car, housing), and Rule 11UA (property valuation for the gifts clause). When a notice cites a Rule, open the Rules book, not the Act.
1961 → 2025 finder (the famous renumberings)
| You knew it as (1961) | Now (2025 Act) | Topic |
|---|---|---|
| 80C | Sec 123 | ₹1.5L basket |
| 80CCD(1B) | Sec 124 | Own NPS +₹50k |
| 80CCD(2) | Sec 125 | Employer NPS 14% |
| 87A | Sec 156 | Rebate to ₹12L |
| 115BAC | Sec 202 | New regime |
| 139 family | Sec 263 | Returns & deadlines |
| 192 / 194-series | Sec 392 | TDS cuts |
| 194-IA/IB + 26QB/QC | Sec 393 | Property/rent TDS |
| 206C | Sec 394 | TCS collection |
| 234F | Sec 428 | Late-filing fee |
During transition, quote BOTH numbers ('234F/428') on replies and paperwork — officers work across both books, and dual citation removes all ambiguity. The complete conversion lives on the mapping page.
Where to read the bare law (free, official)
- India Code (indiacode.gov.in) — the official bare Acts repository. Search 'Income-tax Act 2025', read the section verbatim.
- E-filing portal → Tax Information and Services — Acts, Rules, circulars and notifications in one place.
- Circulars for relief: when claiming CBDT relaxations (deadline extensions, condonations), cite the CIRCULAR number + date — relief lives in circulars, not in sections.
- Our honest workflow: bare section first (what the law says), circular second (what relief exists), guide third (what it means). Never reverse the order.
