HUF Taxation: Own PAN, Own Slabs, Own 80C + Partition & Clubbing
An HUF is a separate tax person — own PAN, own slabs, own ₹1.5L 80C, own ₹12L-rebate question. Fund it via gifts/will/partition — but member gifts get clubbed (64(2)). Karta manages; partition ends it.
HUF in one table
| Topic | Rule |
|---|---|
| Identity | Separate person: own PAN, bank account, slabs, 80C, ITR (usually ITR-2) |
| Create | Deed + PAN + bank account; Karta (manager) operates |
| Fund it | Gifts, will, family partition share, HUF's own business/rent/investments |
| 64(2) trap | Member converting personal assets into HUF = income clubbed with the member |
| Partition | Full partition distributes assets to members (their cost = HUF's cost); partial partitions derecognised |
| Rebate | ₹12L rebate is an individual benefit — HUFs compute plain slab tax (confirm with your CA) |
Why HUF still matters: a second basic exemption
- HUF gets its own everything: PAN, ITR, basic exemption, its own ₹1.5L 80C, its own 80D. It's a parallel taxpayer living inside your family.
- Corpus sources: ancestral property, partition proceeds, gifts received on marriage, and income those assets throw off. Document the corpus — unexplained HUF money invites 68-style questions.
- Partition ends it: only a FULL partition (all assets divided, deed registered) dissolves an HUF. Partial partitions stopped being recognised decades ago — don't try one.
- Honest caveat: HUF suits families with ancestral assets or big rental streams. For a pure-salaried couple, the compliance cost usually outweighs the gain.

You can, but income on a member's converted assets is clubbed back under 64(2) — fund HUFs via will, partition shares or HUF's own earnings instead.
A full partition distributes assets to members and ends the HUF; partial partitions are derecognised for tax.
